Terms and Conditions of Use — Kubree

1. Acceptance of terms

By creating an account, accessing, or using the Kubree service, available at kubree.ai, you agree to be bound by these Terms and Conditions of Use ("Terms"), as well as by our Privacy Notice.

If you do not agree with any of these Terms, you must not use the service.

The service is available exclusively to individuals aged 18 and over.

2. Description of the service

Kubree is an AI-powered personal agent that allows you to:

• Hold natural-language conversations to organize your life, manage tasks, and set reminders.
• Integrate and manage your Google Calendar.
• Integrate and manage your Google email (Gmail) on Premium plans.
• Receive proactive assistance based on your personal context and preferences.
• Store persistent memory of conversations and relevant data for service continuity.

The service is provided by Owen Raymundo Meneses Vega, an individual (persona física), in Mexico. For any matter related to the service, the contact channel is support@kubree.ai.

3. Registration and user account

3.1 Account creation

To use Kubree you must create an account by providing truthful, complete, and up-to-date information. You are responsible for keeping your access credentials confidential.

3.2 Account responsibility

You are responsible for all activity carried out under your account. If you detect unauthorized use, notify us immediately at support@kubree.ai.

3.3 One account per person

Each account is intended for individual use. Sharing access credentials or using the account on behalf of third parties without their knowledge is not permitted.

4. Plans and pricing

Kubree offers different access plans:

Prices may be subject to applicable taxes depending on your jurisdiction. The specific features of each plan are described at kubree.ai/pricing and may be updated with prior notice.

4.1 Billing

Payment for paid plans is charged monthly or annually (as selected) through our payment processor. By providing your payment method, you authorize recurring charges until you cancel your subscription.

4.2 Refund policy

We offer a full refund within 7 calendar days of purchasing a plan, with no justification required. After that period, no refunds are issued for partial periods.

4.3 Cancellation

You may cancel your subscription at any time from Settings → Subscription. Cancellation takes effect at the end of the current billing period.

5. Acceptable use

5.1 Permitted uses

Kubree is designed for legitimate personal assistance. You may use the service to:

• Organize your schedule, tasks, and personal and professional commitments.
• Draft, review, and manage communications.
• Obtain general information and assistance with everyday decision-making.
• Integrate and manage your Google services (Calendar, Gmail) with your express authorization.

5.2 Prohibited uses

The following is strictly prohibited:

• Illegal content: using the service to produce, distribute, or facilitate content that violates applicable law.
• Harmful content: requesting instructions to manufacture weapons, explosives, dangerous substances, or similar.
• Malware: requesting the creation of malicious code, viruses, ransomware, exploits, or hacking tools.
• CSAM: generating, requesting, or distributing any sexual content involving minors. Such conduct will be reported to the competent authorities.
• Self-harm: requesting detailed instructions to harm yourself or others.
• Harassment and discrimination: using the service to harass, threaten, defame, or discriminate against people.
• Impersonation: posing as another person or entity.
• Reverse engineering: attempting to obtain the source code, algorithms, or internal system instructions through prompts or any other technique.
• System abuse: attempting to overload, interfere with, or manipulate the operation of the service.
• Unauthorized automation: using scripts, bots, or automated tools to access the service on a mass scale.
• Resale: reselling or sublicensing access to the service without written authorization.

Failure to comply with these prohibitions may result in immediate suspension or cancellation of your account, with no right to a refund.

6. Artificial intelligence — important limitations

6.1 Nature of the service

Kubree uses third-party artificial intelligence models to generate responses. The AI can make mistakes and produce outdated or inaccurate information.

6.2 Not professional advice

Kubree's responses do not constitute medical, legal, financial, psychological, or any other kind of professional advice. For important decisions in these areas, always consult a qualified professional.

6.3 User responsibility

You are responsible for verifying the accuracy and suitability of any information provided by the agent before acting on it.

6.4 External actions

When Kubree performs actions on your behalf (creating calendar events, sending emails, etc.), it will always request your explicit confirmation before executing them.

7. Intellectual property

7.1 Kubree's ownership

The service, including its design, code, brand, logos, AI system, and documentation, is the property of Owen Raymundo Meneses Vega / Kubree and is protected by applicable intellectual property laws.

7.2 User content

You retain ownership of the data and content you provide to the service. By using Kubree, you grant us a limited, non-exclusive, non-transferable license to process that content solely for the purpose of providing the service.

7.3 Prohibition of reverse engineering

You may not copy, modify, decompile, disassemble, or reverse engineer any component of the service.

8. Privacy and third-party integration

The processing of your personal data is governed by our Privacy Notice, available at kubree.ai/privacidad, which is an integral part of these Terms.

By connecting third-party services (Google Calendar, Gmail), you also accept the terms and privacy policies of those services. Kubree only accesses third-party data with your express authorization and you may revoke that access at any time from Settings → Connections.

9. Service availability

Kubree makes reasonable efforts to keep the service continuously available. However, we do not guarantee uninterrupted availability and reserve the right to perform scheduled or unscheduled maintenance.

We are not responsible for interruptions caused by factors beyond our control, including infrastructure provider failures, internet outages, or force majeure events.

10. Limitation of liability

To the maximum extent permitted by applicable law:

• Kubree will not be liable for indirect, incidental, special, consequential, or punitive damages.
• Kubree's total liability to you will not exceed the greater of: (a) MXN $500 Mexican pesos, or (b) the total amount you paid in the 6 months prior to the event giving rise to the claim.
• Kubree does not guarantee that the service will be entirely error-free, that the agent's responses will always be accurate, or that the service will meet all your expectations.

11. Changes to the service and the terms

We reserve the right to modify, suspend, or discontinue the service or any of its features at any time, with or without prior notice.

When we make material changes to these Terms, we will notify you by email or through a prominent notice in the application at least 15 days in advance. Continued use of the service after the changes take effect constitutes your acceptance of the new terms.

12. Termination

12.1 By you

You may cancel your account at any time from Settings → Account → Delete account, or by contacting support@kubree.ai.

12.2 By Kubree

We may suspend or cancel your account if:

• You violate these Terms or the Acceptable Use section within them.
• Your use poses a security risk to the service or to third parties.
• A competent authority requires it.
• The service is discontinued.

In the event of cancellation due to a violation of the Terms, there will be no right to a refund.

13. Governing law and jurisdiction

These Terms are governed by the laws of the United Mexican States. For any dispute arising from these Terms, the parties submit to the jurisdiction of the competent courts of Mexico City, waiving any other jurisdiction that might apply to them.

14. General provisions

• Entire agreement: These Terms, together with the Privacy Notice and the Acceptable Use section contained within them, constitute the entire agreement between you and Kubree regarding use of the service.
• Severability: If any provision of these Terms is declared invalid, the remaining provisions will remain in full force.
• No waiver: Kubree's failure to exercise any right does not constitute a waiver of that right.
• Assignment: Kubree may assign these Terms in the event of a merger, acquisition, or sale of assets. You may not assign your rights without written authorization.
